What do Hartford Process Servers do?

A process server is a neutral third party responsible for delivering legal documents to individuals—typically the defendant—involved in a court case. In Hartford, as in the rest of Connecticut, this isn’t a casual task. Legal documents must be delivered properly and in strict accordance with the law to ensure the case can move forward.

Because legal documents can’t be sent through the regular mail, dropped off on a doorstep, or delivered to an assistant, lawyers and other professionals hire process servers to deliver the documents directly to their defendants.

Connecticut-Specific Process Serving Laws

Every state has slightly different rules and regulations for process servers.

Here are just a few of the laws that our servers know inside and out:

  • Personal service requires delivering documents directly to the defendant. For personal service, the process server must locate the defendant and hand them the legal documents directly.
  • Service must be directed to authorized officers. Process must be directed to a sheriff, deputy, constable, or other authorized officer or to an “indifferent person” under specific circumstances.
  • Timing requirements are strict. Civil process must be served at least 12 days before the court date for Superior Court cases, giving defendants adequate time to respond. Supreme Court cases require 30 days’ advance notice.
  • Return deadlines must be met. Process must be returned to the clerk at least 6 days before the return day to ensure proper filing and court preparation.
  • Alternative service methods are available. Service can be made by reading the summons to the defendant or leaving an attested copy at their usual place of residence.
  • Substituted service has specific requirements. When personal service is not possible, substituted service may be used by leaving documents with a competent person at the defendant’s residence or workplace.
  • Service by publication follows strict posting rules. When the defendant’s address is unknown, Connecticut courts may authorize service by publication in newspapers for consecutive weeks.
  • Proof of service documentation is required. Process servers must provide proper affidavits of service that meet Connecticut court standards and include detailed information about the time, date, and method of service.
  • Standards of conduct apply to all servers. State marshals must comply with all federal, state, and local laws, act with honesty and professional integrity, and perform services in a timely fashion, and private process servers are expected to meet similar professional standards.
