Here are some of the state’s regulations surrounding service of process, according to the Iowa Rules of Civil Procedure:

  • A named party, a designated representative of the named party, or their attorney can sign in acknowledgement of service of process.
  • It’s a misdemeanor to knowingly try to obstruct a process server from performing their duty.
  • After an initial legal claim filing with the courts, a process server must deliver documents within 90 days. However, if provided with proof of attempted delivery or valid reason for failure of service, the courts may extend the delivery deadline.
  • A recipient of a summons or subpoena must sign an acknowledgment of service.
  • Proof of service must be filed immediately by the process server.
  • Notice of service by mail is permissible with proof of mailing and acknowledgment of service by the intended recipient. 
  • Process servers who are not law enforcement officials can only serve complaints, summons, and subpoenas.
