Service of Process Rules

All of our process servers are well-versed in county and state laws governing service of process.

Unlike some states, Indiana doesn’t require process servers to hold a special license; anyone over 18 who isn’t a party to the case can serve legal documents. Personal service is the preferred method, where the summons and complaint are delivered directly to the recipient. If that’s not possible, documents can be left at the person’s home or workplace with someone of suitable age and discretion.

Indiana also recognizes service by certified or registered mail with return receipt requested, and service is considered complete as soon as the documents are mailed. When a recipient can’t be located or has left the state, service by publication in a local newspaper becomes an option.

It’s worth noting that if someone is served personally, they’re expected to acknowledge receipt in writing—and even if they refuse to accept the documents, service is still considered complete.

Anyone who accepts service on behalf of another person has a legal obligation to deliver those documents promptly. For situations where standard procedures won’t work, the Indiana Supreme Court has the authority to approve alternative service methods. And if a witness fails to appear after being properly subpoenaed without a valid excuse, the court can enforce compliance through attachment.
