Who can be a process server in South Dakota?

Because the rules for process servers are set by each state, you’ll see different guidelines in South Dakota than in its neighbors. South Dakota doesn’t require any licensing, but servers are still expected to follow precise rules.

Here is an overview of who can serve process in SD:

  1. The sheriff or a constable of the county where the defendant may be found
  2. Any other person not a party to the action who is an elector of any state*
  3. For service on an Indian residing in Indian country, a person not a party to the action who is an elector of any state
*In SD, an “elector” is a person who is registered to vote. This means that by default, process servers must be over the age of 18, even though the state code doesn’t specify a minimum age.

Additional rules for South Dakota’s process servers

These are some additional rules for process servers in SD:

  • You must hand-deliver the summons to the person being served.
  • If you can’t find the person, you can leave the papers at their home with someone who lives there who is at least 14 years old.
  • When serving a subpoena, you must pay the witness fees and travel costs upfront.
  • To serve a company, give the papers to the president, partner, boss, officer, director, or registered agent.
  • If you can’t find these company officials, you can leave the papers at any office of the company with whoever is in charge.
  • When serving government entities, there are special rules about who can accept the papers.
  • For children under 18, serve papers to their parent or guardian. If the child is over 14, you must also serve the child directly.
  • You must prove you served the papers; sheriffs use a certificate, other servers use a sworn statement, or the person can sign saying they got the papers.
  • Non-residents who are served with a subpoena in South Dakota must follow it. Their travel pay is figured from where they were served.
  • If there are minor mistakes in the paperwork, the court can fix them as long as they don’t harm anyone’s rights.
