  • Defendants are required to answer a served complaint within 21 days
  • If damages are sought, the amount must be specified in the written complaint
  • A digital service of process may be served if a case is filed electronically   
  • Per Virginia Code § 8.01-286.1, a plaintiff must serve a defendant within 12 months of filing a complaint
  • A judgment cannot be filed against a defendant who was not delivered a service of process within 12 months of the filing date
  • Cross claims may be filed within 21 days of service to the defendant
  • Service of process can be left on the door of a named party  

Hours a process server can work in Virginia

Virginia does not have laws that prohibit a private process server from serving a defendant on holidays or over the weekend. Nor are there limitations on the hours a process server can work throughout the day.
