How a Private Process Server Works in Missouri

The laws and regulations a process server in Missouri must follow vary from other states, and may even vary based on municipality. It’s important to know what these laws are before you begin a partnership with a private process server.

Private process servers are citizens, as opposed to law enforcement officials, who have been recognized by the courts as certified to serve legal papers. These individuals must be an unbiased third party with no connection to the case.

What papers can a private process server deliver in Missouri?

In Missouri, criminal summons must either be served by the court clerk via first class mail, or by a law enforcement officer in person. In civil cases, a process server might serve any of the following:

  • Copy of complaints filed with the court
  • Subpoenas for mandated court appearances
  • Summons to any named party in a case
  • Any other case-related documents

Who a process server in Missouri can serve?

Although any named defendants in a case in Missouri must be served, there are some caveats. For example, minors or mentally incapacitated adults can only be served via a parent or legal guardian. Based on the Missouri Rules of Civil Procedure, a process server can also deliver legal papers to the following: 

  • Corporations, firms, or persons from outside of the state in the case of: business transactions, contracts, or real estate within Missouri
  • Insurance companies (both authorized and unauthorized to operate in MIssouri)
  • Estate conservators
  • Individuals named in a case
  • Government entities, public, and quasi-public corporations via the county court clerk
  • Designated corporate officials
  • Heads of unions

What hours can a Missouri process server deliver legal papers?

A process server in Missouri doesn’t have time of day restrictions limiting when papers can be served. This means that every time of day is feasible for process serving. Process servers can work on weekends as well. 

A defendant has 30 days to respond to the process. If serving attempts aren’t successful within 30 days of the first attempt, the process must be returned to the court with an explanation of why papers weren’t served. The county clerk may then extend the time for process to 90 days.

Typically, a great process server will attempt to serve an intended recipient within normal business hours. However, if these attempts fail, late nights and weekends fall within legal compliance. Proof of service must be filed with the courts. 

Other Missouri process serving laws and regulations 

Although a private process server in Missouri doesn’t need a license, specific cities have qualification restrictions in place. For example, in St.Louis, a process server must be over 21, have attained a high school diploma or GED, and is required to take and pass five training classes and apply for a license.

Throughout the state, a process server must be at least 18 years old and an unbiased third party. It’s important that lawyers familiarize themselves with the specific process serving regulations in the municipalities where they may need to serve process.
