Process Server in Florida

If you’re filing a court case in Florida, a process server is a vital component to begin your path toward justice. Whether you’re an attorney or a plaintiff in a lawsuit, you must serve a defendant sufficient notice of your planned legal action.

Unfortunately, just stating your intent to sue does not begin the legal process — you must file the appropriate documents with the Florida courts, and ensure the target of your lawsuit is made aware of your case. Firefly Legal can take care of your process serving so that you can concentrate on the road to justice ahead.

Process servers are required to serve legal documents within a specific time frame to ensure that the legal process moves forward efficiently.
Process servers must ensure that they serve the correct individuals or entities and often provide proof of service in the form of an affidavit or a certificate of service.

What You Need to Know About Florida Process Servers

An inept or sloppy process server could nullify your case, or cause monumental delays. You need a professional civil process server who is an unbiased third party. You need a process server who’s committed to excellence and discretion, and can carefully follow the requirements of serving processes in Florida.

How Does Hiring a Florida Process Server Work?

In order to serve legal documents to a party (or parties) you’re filing a lawsuit against, you need to have an unbiased third party physically deliver said documents.

Although there are many legal companies that boast of process services, it’s vital that you research their track records, online ratings, and client testimonials. Before you select a process server, discover answers to the following questions:

  • Have they worked with reputable law firms?
  • How long have they been in business?
  • Do their serving processes reflect any new changes in legislation?
  • Does the company offer process serving in other states?
  • Is the company SOC 2 certified?

What a Florida Process Server Does

In Florida, as well as nationwide, a process server is an unbiased third party who goes through extensive training in order to serve important documents to legal defendants named in court proceedings.

Process servers can’t just mail these documents, but must deliver them in person, and ensure that they have correctly identified the party whom they’re serving.

For example, if a process server entered an office and just left the legal documents at the front desk rather than giving them to a named defendant, the papers would not be considered legally served.

A process server must also ensure that their delivery is in compliance with Florida regulations and record their deliveries in a legally credible manner. This requires thorough knowledge of the laws surrounding process serving, and painstaking adherence to any legal nuances that, if neglected, could jeopardize a court case.

Why You Need a Process Server

When you hire a process server, the wheels of your legal case against other parties begin to turn. Federal and Florida state law both afford a defendant the opportunity to answer or contest a lawsuit, thus, all named parties in a suit must be made aware of your court filings.

Unfortunately, unscrupulous defendants may be aware of an impending lawsuit, and may change their normal daily routines to avoid a process server. A process server is trained to locate defendants and to ensure proper transference of legal documents. Your case cannot begin until this step is taken.

Who Should Get Served in a Legal Case?

In Florida, a process server should present legal documents to all named parties in a court case. If your lawsuit is filed against a company, a designated representative of the company typically serves as a recipient. A process server can ensure this person is identified before they are served.

The recipients of these documents can include:

  • Multiple individual defendants
  • Corporations
  • Hospitals
  • Local governments
  • State governments

Why Florida Attorneys Should Use Reliable Process Servers

After a Florida attorney files a petition or claim with the courts, a legal summons, outlining the complaint, is issued to serve any defendants in the case with notice of a lawsuit. This summons, along with any further documentation, must be delivered to the defendant on the plaintiff’s behalf.

Thus, most Florida attorneys have a process server company that they rely on to provide accurate and timely documentation to a defendant. It’s vital that lawyers use credible process servers who continually act in compliance with Florida laws.

Florida Regulations on Process Servers

The laws and regulations on process servers in Florida may vary from other states. Therefore, it’s important to use a professional process serving company that has comprehensive knowledge of Florida laws, and will ensure that their practices are in compliance with these laws.

In Florida, in a criminal case or an enforceable civil process, a process server must either be an authorized law enforcement officer or an unbiased third-party given permission by the court to serve legal documents.

The sheriff in your area of residence may maintain a list of valid, approved process servers who are legally permitted and designated to serve. A Florida process server must also be certified to perform serving duties.

Process servers help to uphold the principles of fairness and justice in legal proceedings.

Other Notable Florida Process Server Regulations

Per Florida statutes Title VI and 48.021–48.31, the following laws also apply to process servers:

  • A minor named as a defendant cannot be served directly. Instead, the parent or legal guardian of a minor should be served (48.041)
  • A state prisoner can be served directly (48.051)
  • Appointed process servers must be full-time residents of the state (48.021)
  • Processes on out-of-state individuals or corporations doing business in Florida must be served to a representative of these parties in Florida (48.071)
  • No processes shall be served on a Sunday (48.20)
  • Labor union process serving must be served to the individual in charge of the union (48.141)
