Choosing a Private Process Server in Vermont

The legal community in Vermont is small and well-connected. Because there are limits on who can serve process, there is only a small community of process servers in the state. Word of mouth goes far about which process servers do the job well.

Firefly Legal is known for providing lawyers with process servers who can get the job done, both quickly and accurately. We contract with the best vendors nationwide, including here in Vermont.

When you need a process server in Vermont, you can trust Firefly Legal to connect you with an experienced and knowledgeable process server. Our clients get timely, professional service every time!

The right process server is both courteous and highly punctual.
Firefly Legal gives its stamp of approval only to the best process servers in Vermont.

The importance of hiring the right process server in Vermont

To understand the importance of hiring the right process server, all you have to do is think about what happens when you hire the wrong process server:

  • Sloppy mistakes cause headaches for you and your firm
  • Those mistakes can get expensive, especially if the legal process is delayed
  • The service of process can get bogged down by having to find a new process server or wait for the first one to get the job done
  • Legal proceedings get delayed

When you have the right process server, on the other hand, things get done quickly and efficiently! You no longer have to worry about how long it’s going to take or whether or not your server is going to find the right person or follow all the rules.

Firefly Legal’s process servers are courteous and time-conscious. Whether they are serving at private residences, public spaces, jails or prisons, attorney’s offices, workplaces, or anywhere else that they can legally serve, they do exceptional work.

Do you have a difficult-to-find client? Our process servers are equipped to implement effective skip-tracing measures. Whether you are an attorney, a government office, a PI, or another Vermont professional in need of a process server, Firefly Legal can provide you with the best of the best.

Who can be a process server in Vermont?

Each state sets its own rules about who can serve process. In Vermont, there are three categories of potential servers:

  • Sheriffs or deputy sheriffs
  • Constables or other legally authorized parties
  • “Indifferent persons” who have been appointed by a judge

Additionally, if process needs to be served in a county or state that is far away from the issuing county, special appointments can be made with the goal of reducing travel costs.

To serve process, an individual must:

  • Be 18 years of age or older
  • Be unrelated to the case
  • Be authorized by the court in the county where you are serving

Rules & responsibilities of process servers in Vermont

No matter where you do business in the US, the basic duties of process servers are the same: deliver essential legal documents to defendants and other parties named in lawsuits.

It is crucial to choose a process server who understands the specific rules that govern their work in Vermont. Here are some of the rules that Vermont’s process servers have to abide by:

  • Process servers in Vermont do not need to be licensed, but they must be authorized by the county court in which they are serving.
  • Service can be made by sheriffs, deputy sheriffs, constables, other persons authorized by law, or indifferent persons specially appointed by a judge.
  • Personal service within Vermont must be made by delivering copies of the summons and complaint to the individual personally or leaving them at their dwelling with a person of suitable age and discretion.
  • Service outside Vermont can be made in the same manner as within the state by any person authorized to serve civil process in that location.
  • Service by mail is only allowed in certain cases, such as when personal service cannot be made after a reasonable amount of effort.
  • Service by publication is only possible when ordered by the court if other methods of service cannot be made with due diligence.
  • A process server must make proof of service on the original process or attached paper, and return it to the plaintiff’s attorney (with fees and charges noted).
  • The plaintiff’s attorney must file the proof of service with the court within the time the served person has to respond.

Serve Defendants right the first time.

Being a leader in the civil process service industry means providing our clients with unparalleled integrity, excellence, and reliability.
