Who can become a process server in Oregon

Service of process rules are determined on a state-by-state basis. Each state sets their own rules, requirements, and limitations on who can be a process server. Sometimes, there are even city- or county-based requirements.

In Oregon, the rules are relatively straightforward. Process servers do not have to go through any licensing body to do their jobs. 

Some rules they must follow include: 

  • Age requirement: Process servers must be at least 18 years old.
  • Residency: The server must be a resident of the state where service is made or a resident of Oregon.
  • Relationship to the case: The server cannot be a party to the action, nor an officer, director, or employee of, nor attorney for any party, corporate or otherwise. There is an exception for attorneys serving papers pursuant to Rule 7 D(2)(d)(i).
  • Licensing: Oregon does not require process servers to be licensed. Any person meeting the above criteria can serve process.
  • Insurance: While it is not required for all types of service, state law requires that any person who serves a Writ of Garnishment must have Errors & Omissions (E&O) insurance coverage with minimum limits of $100,000.
  • Competency: The rules state that service may be made by any “competent person” meeting the above criteria, though “competent” is not specifically defined.
  • Sheriff’s deputies: A sheriff or sheriff’s deputy may also serve process, with compensation prescribed by statute or rule.
  • Special cases: For service to law enforcement agencies, there are specific rules about who can be served and how.

Because most people could technically serve as a process server in Oregon, it becomes even more important to find servers who understand the responsibilities and requirements of the job. Rules for process servers in Oregon

One of the biggest challenges when it comes to hiring a process server is finding someone who understands the rules and regulations that servers have to follow. If you choose someone who doesn’t know what the rules are, they could jeopardize your entire legal case. 

In Oregon, some of the rules include:

  • Process servers must hand papers directly to the person for personal service.
  • When personal service is not possible, substituted service allows the server to deliver legal documents to a resident at the home who is at least 14 years old, then mailing the documents to the defendant.
  • Office service requires leaving papers with someone in charge at the defendant’s workplace, followed by mailing the documents to the defendant.
  • Service by mail uses certified, registered, or express mail with return receipt, plus first-class mail.
  • Mailing for substituted or office service must be done promptly after in-person delivery.
  • Servers must allow sufficient time for mail recipients to receive and respond.
  • A detailed proof of service document must be completed and filed with the court promptly.
  • Subpoenas for document production have a 14-day minimum service requirement unless shortened by court order.
  • Serving minors or incapacitated persons requires additional service to guardians or caretakers.
  • Alternative service methods need court approval if standard methods fail.
  • Service timing must allow defendants reasonable time to prepare. 
  • Servers must comply with laws restricting disclosure of certain information, such as HIPAA-protected or redacted information.
  • Multiple service attempts may be necessary.
  • All information in the proof of service must be truthful and accurate.
  • Servers must respect property rights and cannot trespass or use force to effect service.
