South Carolina Rules of Civil Procedure

The South Carolina Rules of Civil Procedure pertain to anyone who chooses to become a process server. Although the state does not require licensing, and will allow any unbiased third party over the age of 18 to become a private process server, there are mandated requirements that a process server working for any attorney must follow.

Here are some of the specific laws mandated by the Rules of Civil Procedure that all private process servers must follow:

  • In specific circumstances, a summons for some business entities may be served to and legally accepted by the Secretary of State. 
  • A summons delivered to the Secretary of State must be served by a registered agent recognized by the Secretary of State’s office.
  • A summons must be issued by a plaintiff or the plaintiff’s attorney. 
  • All summons and complaints must be filed together.
  • A summons must include the name of the state, county, and court where it’s filed.
  • Copies of an original summons must be served to each named defendant in a complaint.
  • Service to a named government party may also be made by certified mail.
  • A process server cannot pose as someone else in order to serve court documents.
  • After being served, a defendant has 30 days in which to respond to a complaint or summons.

Who a process server can serve in South Carolina 

A private process server in South Carolina is permitted to serve any of the following parties:

  • Any competent person over the age of 14
  • Copies of a summons may be left with a competent person who lives in the same residence as a named party
  • An adult under guardianship or an individual under the age of 14 via a parent or guardian who is a resident of South Carolina
  • An imprisoned or institutionalized individual must be served through direct delivery by a sheriff or deputy
  • An officer, managing or general agent of a domestic or foreign corporation or partnership
  • A summons for the state of South Carolina, a state officer, or a state agency may be served to the state’s Attorney General
  • The chief executive officer or clerk of a governmental subdivision

In South Carolina, a private process server can serve an intended recipient seven days a week. However, they cannot interrupt a Sunday religious service to deliver legal documents. 

Although the state does not require time restrictions on the delivery of legal documents, most process servers will avoid serving anyone between the hours of 10:00 p.m. and 6:00 a.m.
