The difference between personal and domiciliary service in Louisiana

Although Louisiana doesn’t require licensing for process servers, a private process server must be over the age of 18 and cannot be a party to the case. However, state law does require personal service in some cases and domiciliary in others.

Personal service of process requires that an intended recipient is directly served at home, work, or wherever they’re located. This type of service of process is mandated in divorce cases when the involved parties still live together, if a defendant has a permanent Louisiana address but is located out of state, or if a defendant is temporarily staying at someone else’s home.

Domiciliary service of process can be left with an adult other than the intended recipient who lives at the recipient’s primary address (the address listed on their regular bills or on their driver’s license). In cases where personal service of process is not possible, domiciliary service of process can be utilized. However, if both parties in a case reside at the same address, personal service of process is required.          

Louisiana Code of Civil Procedure

Other laws and regulations for service of process in Louisiana include:

  • A process server must serve a summons or subpoena to a defendant within 10 days of the court filing unless proof of attempted delivery is presented to the court.
  • A citation service must occur within 90 days of court filing.
  • Depending on the nature of the case, a defendant has 21-30 days to respond to service of process.
  • A filing fee is required for every civil case. However, the fee may be waived in special circumstances and the U.S. Marshal Service may serve a summons or complaint. 
  • A pleading will appear on record within 1-2 business days of filing.
  • Receipt of delivery cannot be verified by an electronic signature.
  • A certificate of service acts as proof of delivery.

A process server in Louisiana can serve an intended recipient, via both personal and domiciliary service, any day of the week and at any time of day. There are no restrictions on weekends or holidays. 

However, the industry standard is to avoid serving anyone between the hours of 10:00 p.m. and 6:00 a.m. Although it isn’t illegal to serve during this time period, it’s good practice to adhere to this time limitation whenever possible.
