Which states and territories does Firefly Legal cover?

We contract private process servers nationwide. However, the Firefly Legal headquarters are located in the suburbs of Chicago, Illinois. We offer legal support services and Firefly process servers in every state, including: 

Every state has set laws and regulations for process servers. There are restrictions on who can be a process server and what hours a process server can operate in several states, including New York. You can research any restrictions through the Firefly Legal process server details for your location.

In order to serve international recipients, Firefly Legal can partner with firms in other countries or territories. Similarly, international defendants with stateside operations can be served by our private process servers.

When necessary, Firefly Legal will attempt to successfully serve an intended recipient overnight or within 24 hours. However, this expedited service does require additional fees.

A Firefly Legal private process server is available to work 24 hours a day, seven days a week depending on the needs of your case and your specific instructions. However, it’s important to review your state or region-specific Rules of Civil Procedure, as some states have restrictions that prohibit a process server from delivering documents on holidays or weekends.

What is a service of process?

Service of process is the legal start of a lawsuit, when a party formally files a complaint with the courts, and then delivers initial documents such as the complaint or a summons to the named defendant (s) in the case. 

These legal documents notify a defendant (s) of the legal action filed against them as the first step in a lawsuit. Depending on state law, the defendant (s) then have a specific time period in which they can respond to the complaint or file a counterclaim.

The Firefly Legal process service contract is comprehensive and thorough and goes far beyond standard document delivery.

Your process serving contract includes the following:

  • Vital communication about the status of your case
  • Discretion and sensitivity in document delivery
  • Due diligence affidavit (this includes all recorded notes from the process server, delivery confirmation, comprehensive skip trace results, and any other vital case data)

  • Latest technology for innovative solutions
  • Real-time status updates

If an intended recipient of the service of process cannot be located, a Firefly Legal process server will use extensive skip tracing methods and innovative solutions to locate them. After several attempts, if the recipient still cannot be located, the process server will notify the courts and comply with the state’s regulations to file service attempts, and we will provide you with a Due Diligence affidavit.

In many states, a process server can serve an employee, manager, managing partner, or officer of a business. However, a private process server should have demonstrated knowledge of your state or region’s laws and comply with any restrictions on serving someone at their workplace.

A Firefly Legal process server will make 3-4 attempts (and more if necessary) to serve someone before filing attempted delivery documents with the courts. In some states, a default judgment can be made against a defendant who cannot be served.

What is skip tracing and how does it work?

Skip tracing is the practice of tracking down an intended recipient who cannot be located. A Firefly Legal process server will utilize innovative and ethical methods to locate intended recipients of your legal documents.

Firefly Legal may use the following skip tracing methods:

  • Digital footprint analysis (reviewing online activity and interactions)
  • Extensive research of public and private databases (including employment histories and registered residential addresses)
  • Field investigations (on the ground research, relevant interviews, lead validation, etc.)
  • Personal and professional histories (For example, education, professional associations, personal hobbies and favorite spots to socialize)
  • Social media tracking (Utilizing social media platforms such as Facebook and Instagram to trace post information and geotags)
  • Surveillance techniques (a process server may use legal surveillance to verify that an individual is present in a specific location before attempting to serve them)

A Firefly Legal process server will use innovative methods and technology tools to locate an intended recipient of your legal documents. However, we will never cut legal or ethical corners and always remain in compliance with state regulations.

Firefly Legal will manage all of the court filing needs related to your case. This includes time-sensitive filings and standard filings. We’ll file your documents electronically or in person. Electronic court filings are not available in every state only, It’s important to verify your state’s regulations on court filings before you contract Firefly Legal for court filing services.

To track the status of your court filing, you can use our proprietary Firefly Legal Case Management system for safe and secure real-time status updates and pertinent case details.

The deadlines for court filings vary based on the circumstances of your case, the type of case, and the documents you’re filing. Federal and state case-related deadlines will depend on regulations like a statute of limitations and the time a defendant is allowed to respond to your claim.

If rush court filings are necessary to your case, especially rush in-person filings at the courthouse, Firefly Legal will make every attempt to file in a timely manner.

What documents can Firefly Legal retrieve?

Document retrievals may include any sensitive data related to your case. Firefly Legal may retrieve a variety of documents for our clients including (but not limited to):

How is the cost of process serving calculated?

The cost of process serving is based on your location, the number of service of process attempts required, the work required, and any specific or unique needs of your case.

Firefly Legal offers base rates for our services, but each case may require additional charges depending on the work required.

We accept cash, check, and credit card for payments.

Rush services do require additional fees, based on the extra work and nature of the service.

We do not offer recurring billing for regular services as additional fees may be required based on the requirements of each specific case.
