Who a process server can serve in Alabama

Per Rule 4 of the Alabama Civil Rules of Procedure, a private process server in Alabama can serve any of the following parties:

  • A minor over the age of 16
  • Legal guardian, parent, or spouse of a minor under the age of 16 or of an incompetent adult
  • Superintendent of a hospital or institution where an incompetent individual is confined
  • An incarcerated person
  • Officers or managing and general partners of a foreign or domestic corporation, limited or limited liability partnership or company, and unincorporated associations and organizations
  • Administrative officers of state agencies, departments, institutions, and offices
  • Chief executive officers, clerks, and designated officials of local government offices and agencies

When an Alabama process server can serve papers

Some states have strict limits on the hours and days a process server can deliver documents. However, in Alabama there are no prohibitions on service of process over holidays and weekends. The only time restriction in place requires process servers to deliver after 6:00 a.m. and before 10:00 p.m.

However, Rule 4 requires the following statutes of limitations on service of process:

  • Service of summons and complaints must be made within 120 days of a filed complaint. 
  • If service cannot be completed within 60 days of issue from the court, a process server must inform the court and return the process to the court clerk.
  • A process server must record all delivery attempts.
