About Process Servers in California

The role of a process server is mostly the same from state to state, but there are variations based on state law.

A process server delivers important legal documents to defendants and other named parties in lawsuits and court proceedings. Because these documents can’t typically be sent through the mail or dropped off at an office or home, attorneys and other legal professionals hire process servers to follow all the rules of the state in which they operate.

California does not require process servers to be licensed, but they must register with the state if they serve in more than 10 cases per year.

Some of the rules that govern process servers in California include:

  • Process servers in California do not need to be licensed but must be registered and bonded in the county where they reside or have their principal place of business if serving more than 10 papers per year.
  • Anyone 18 years or older who is not a party to the action can serve the process in California.
  • Service is valid even if done by someone violating the business/professional code governing process servers.
  • For personal service, the server must deliver a copy of the summons and complaint directly to the person being served.
  • Substituted service is allowed by leaving copies at the person’s office, dwelling, business, or mailing address with someone competent and then mailing a copy.
  • Process servers must be granted reasonable access to gated communities to perform service by showing ID and registration.
  • Service by mail is allowed by sending summons/complaints by first-class mail with an acknowledgment notice.
  • Service outside of California can be done as specified by that location’s laws or by first-class certified mail with a return receipt.
  • Proof of service must be made by affidavit of the server detailing the time, place, manner, and facts showing proper service.
  • Declarations under penalty of perjury can substitute for sworn affidavits for proof of service.

Serve Defendants right the first time.

Being a leader in the civil process service industry means providing our clients with unparalleled integrity, excellence, and reliability.

Who Hires Process Servers in California?

Although lawyers make up the largest percentage of people who hire process servers, there are some other industries that need the service of a process server.

Process servers play a crucial role in the legal system by formally delivering court orders, notices, and demands on behalf of various entities and individuals in compliance with proper procedures.

Lawyers hire process servers to formally deliver legal documents in compliance with required procedures.
  • For personal matters, individual citizens can directly employ process servers without requiring legal representation for things like small claims cases, family court proceedings, inheritance affairs, and other private legal processes.
  • Businesses frequently utilize process servers to properly serve documents related to corporate legal disputes, such as contract issues, intellectual property conflicts, and other commercial matters.
  • Government agencies depend on process servers to execute legally mandated actions like enforcing tax obligations, carrying out evictions, and other required governmental directives per court orders.
  • Insurance companies use process servers to formally notify relevant parties about claims conflicts, policy cancellations, rights to recovery, and other insurance-related legal issues that require proper service.
  • Debt collection services rely on process servers to legally deliver payment demands, wage garnishment orders, case filings, and other documents as they pursue recovery of unpaid debts.
  • Property management firms hire process servers to formally communicate with tenants regarding matters that necessitate proper service, such as overdue rent, lease violations, eviction notices, and rental disputes.
  • Private investigators sometimes collaborate with or operate as process servers themselves, employing legal summonses to compel the production of information, records, witness testimony, and other evidence for their cases.
