The role of a process server is mostly the same from state to state, but there are variations based on state law.
A process server delivers important legal documents to defendants and other named parties in lawsuits and court proceedings. Because these documents can’t typically be sent through the mail or dropped off at an office or home, attorneys and other legal professionals hire process servers to follow all the rules of the state in which they operate.
California does not require process servers to be licensed, but they must register with the state if they serve in more than 10 cases per year.
Some of the rules that govern process servers in California include:
- Process servers in California do not need to be licensed but must be registered and bonded in the county where they reside or have their principal place of business if serving more than 10 papers per year.
- Anyone 18 years or older who is not a party to the action can serve the process in California.
- Service is valid even if done by someone violating the business/professional code governing process servers.
- For personal service, the server must deliver a copy of the summons and complaint directly to the person being served.
- Substituted service is allowed by leaving copies at the person’s office, dwelling, business, or mailing address with someone competent and then mailing a copy.
- Process servers must be granted reasonable access to gated communities to perform service by showing ID and registration.
- Service by mail is allowed by sending summons/complaints by first-class mail with an acknowledgment notice.
- Service outside of California can be done as specified by that location’s laws or by first-class certified mail with a return receipt.
- Proof of service must be made by affidavit of the server detailing the time, place, manner, and facts showing proper service.
- Declarations under penalty of perjury can substitute for sworn affidavits for proof of service.
