Who can be a process server in Connecticut?

Connecticut law requires that sheriffs, deputies, constables, and other officers perform the service of process, except in two specific scenarios. 

  1. A neutral third party (“indifferent person”) can serve process if there is more than one defendant named in a claim, and those defendants live in different counties. 
  2. An indifferent person can also serve process if a plaintiff believes that having an officer of the law as a process server could jeopardize their case and the probability of getting their debt paid back

There are only about 10 process servers from Connecticut who are members of the American Association of Professional Process Servers, but there are other servers who are working in the state despite not being members. The basic responsibilities of a process server are the same no matter where you are located in the US. However, each state has its own rules and requirements for servers to follow. In smaller states or in areas near state borders, it is common for servers to work in multiple states. 

Process servers deliver essential legal documents to defendants and other named parties in lawsuits and other court proceedings. These documents require special handling and delivery, and can’t be simply dropped into the regular mail.

Connecticut does not require servers to be licensed or registered with the state, which means you have to be particularly careful when choosing.

These are some of the rules that Connecticut process servers have to follow: 

  • Process must be directed to a sheriff, deputy, constable, or other authorized officer. 
  • Civil process must be served at least 12 days before the court date for Superior Court cases. This gives defendants adequate time to respond.
  • Supreme Court cases must be served at least 30 days before the court date. 
  • Process must be returned to the clerk at least 6 days before the return day. This ensures proper filing and court preparation.
  • Service can be made by reading the summons to the defendant or leaving an attested copy at their usual place of residence. This allows for different service approaches.
  • For private corporations, service can be made on various officers or agents. This ensures corporations can be properly served even if specific individuals are unavailable.
  • Subpoenas must be served at least 18 hours before the designated appearance time, unless otherwise ordered by the court. This gives witnesses reasonable notice to appear.
