Who can become a process server in Delaware

Every US state sets its own rules that process servers must follow. That’s why you will find significant variation from one state to another. Although some states require their servers to undergo training and certification, other states simply require the process server to be a legal adult (18+) and unrelated to the case. 

Delaware does not require any licensing for process servers. This means that it is the responsibility of the person retaining the server to choose someone who is qualified and experienced. 

Process servers must be:

  • Not a party to the case
  • At least 18 years of age
  • No licensing requirement in Delaware

Authorized servers include:

  • Sheriff or deputy sheriff
  • Anyone specially appointed by the Court
  • For subpoenas specifically, any person meeting the basic age and non-party requirements

Servers must follow the rules for serving different entities: 

  • For state entities, documents must be served by delivery to the Attorney General, State Solicitor, or Chief Deputy Attorney General
  • For corporations, documents can be served on officers, directors, managing agents, or other authorized agents
  • For municipal corporations, documents must be delivered to any member of its governing board

Additional rules: 

  • For service outside Delaware, servers must either:
    • Be authorized under Delaware law
    • Be authorized under the law of the place where service is being made
    • Be specially designated by a Delaware court

Service of process rules in Delaware

Here is an incomplete list of additional rules that Delaware process servers must follow.

  • If someone refuses to accept mail or delivery service, that refusal counts as delivery. The returned mail marked “refused” serves as proof that service was attempted.
  • When serving documents to someone under 18, the server must give them to their parent or guardian. If there’s no guardian in Delaware, you need to serve the person who is taking care of the minor.
  • You can serve papers at someone’s home by leaving them with any adult who lives there. They just need to be “of suitable age and discretion.”
  • When serving a state government agency, you must serve either the Attorney General, State Solicitor, or Chief Deputy Attorney General. Serving anyone else at the agency isn’t good enough.
  • For corporate service, if you can’t find any officers or directors in the county, you can leave the documents at any office of the company with whoever’s in charge at that location.
  • Delaware attorneys can issue and sign subpoenas themselves. They don’t need the court clerk to do it. This is because they’re considered “officers of the court.”
  • When serving papers outside Delaware, servers can follow either Delaware’s rules or the rules of the state where they’re serving, whichever works better.
  • When serving someone who is considered “mentally incompetent,” you must serve their court-appointed trustee or guardian. If there isn’t one, you can serve an adult who lives with them.
  • The person serving papers must file proof of service promptly, but even if they forget to file this proof, it doesn’t invalidate the service. The service still counts as long as it was done correctly.
