Who Can Serve in Georgia?

Unlike some other parts of the country, Georgia has some fairly strict requirements as to who can serve.

  • Sheriffs and deputies: Sheriffs and their deputies can serve legal documents within their jurisdiction.
  • Private individuals: Private individuals can serve as long as they are at least 18 years old, a U.S. citizen, and are not a party to the case. They must undergo a background check and undergo training to become certified.

Special Requirements for Process Servers in Georgia

  • Certification: Private process servers in Georgia must be certified. Certification ensures that they are trained in the laws and procedures governing the service.
  • Jurisdiction: Private process servers must serve legal documents in the judicial circuit for which they are certified. They cannot serve statewide unless authorized to do so.
  • Court approval: In some civil cases, a private server must be approved by the court.
  • Background check: Private process servers must pass a background check by the Georgia Sheriffs Association.

Methods of Service

Georgia follows traditional methods of service similar to other states in the country, including:

  • Personal Service: Delivering documents directly to the person being served.
  • Substituted Service: If delivering directly to the respondent isn’t possible, leaving the documents with a responsible adult at the defendant’s home is sometimes permitted.
  • Service by Mail: Permitted in certain situations, such as serving corporations.
  • Service by Publication: Although rare and requires court approval, sometimes service by publication is allowed when the defendant cannot be located.

Time Limits

Unlike other states, legal documents are generally expected to be served five days after the process server receives them. Although this timeframe is encouraged, it is not mandatory; however, timely service is critical to ensure the defendant is notified and can respond accordingly. This highlights the importance of hiring a professional process server to facilitate prompt and effective service.
