What do Process Servers do in Indiana?

What is a process server, anyway?

process server is an individual who operates as a neutral third party in a legal dispute whose job is to deliver important legal documents and paperwork to defendants.

Legal docs can’t be sent through regular mail. They can’t be dropped off on a doorstep or simply handed over to an assistant. In every state, there are specific rules that govern how process servers can do their work.

Indiana doesn’t require process servers to carry a special license, but all of our Firefly Legal process servers must meet the following requirements to work for us:

  • Be 18 years old or older, per Indiana law
  • Go through significant training
  • Be able to locate and confirm the the identity of defendants
  • Be capable of adhering to all of Indiana’s service of process laws
  • Consistently deliver legal documents to the right defendant(s)
  • Always record proof of the timely delivery of documents
  • Understand the server’s burden to follow all laws so that they never hinder the court case

Indiana’s Process Serving Laws

These are some of the rules that govern Indiana’s process servers, including all of our team members here at Firefly Legal:

  • Process servers are not required to be licensed in Indiana. Anyone over 18 can be a process server as long as they are not a party to the case.
  • Personal service can be delivered directly to the person being served by delivering a copy of the summons and complaint.
  • If personal service fails, the summons can be left at the person’s dwelling house or place of employment with someone of suitable age.
  • Service is also effective by sending the documents via registered or certified mail with a return receipt requested.
  • Service is complete upon mailing.
  • If the person to be served has left the state or cannot be located, service by publication in a local newspaper is allowed.
  • A person being served must cooperate and acknowledge receipt in writing if served personally. Even if the person refuses the documents, this is still considered an effective completion of service.
  • Anyone who accepts service for another person must promptly deliver the documents to that person.
  • The Indiana Supreme Court can authorize alternative means of service if standard procedures are impractical.
  • A subpoena can be enforced by a court attachment if a witness fails to appear without an adequate excuse.
  • Non-resident plaintiffs can be required to attend a deposition in Indiana at their own expense.
