  • A defendant must answer a summons within 21 days of process service.

  • A process requiring the seizure of property or arrest may only be served by a law enforcement official approved by the Michigan courts. 
  • Proof of service can be verified by a defendant’s signature and the date affirming delivery, a certificate of service from an appointed court officer or attorney, and a court-filed written statement with the details of service and delivery.
  • A summons may be issued via certified, registered mail. 
  • A process server cannot serve a party coming or going from court in a matter where their presence is required.
  • State legislature members are exempt from the rules of process.

A process server in Michigan must comply with the summons limitations, and ensure that a defendant is served within 91 days of an issued summons. This allows ample time for a named party to respond to the summons.
