Who can become a process server in Mississippi

Each state sets its own rules for service of process. Additionally, there may be rules set by specific counties. The Mississippi rules for the serving process are not very restrictive. Servers don’t even need to be licensed by the state. However, servers must follow all rules and guidelines, and choosing 

Here are some of the basic rules that Mississippi process servers must meet and abide by: 

  • Age requirement: Process servers must be at least 18 years old.
  • Relationship to case: The server cannot be a party to the action. This is explicitly stated in the rules as a key requirement.
  • Licensing: Mississippi does not require process servers to be licensed. Any person meeting the basic requirements can serve process.
  • Return of service: The server must promptly make proof of service to the court. If the server is not a sheriff, they must provide an affidavit of service.
  • Personal service requirement: Service must be executed upon the witness personally when serving subpoenas.
  • Time constraints: Process servers have 120 days from the filing of the complaint to complete service, unless good cause can be shown for delay.
  • Fee regulations: When serving a non-party witness with a subpoena, the process server must tender the fee for one day’s attendance plus mileage allowed by law at the time of service (except when serving for the State of Mississippi).
  • Service documentation: The server must file a certified statement with the clerk of court detailing the date, manner of service, county of service, names of persons served, and the server’s contact information.
  • Location restrictions: When serving residents for depositions or inspections, service can only be made in the county where the person resides, is employed, or conducts business, unless the court orders otherwise.

  • Defendants must be given 30 days from the first publication date to appear and defend when service is made by publication.
  • The summons must be published once per week for three successive weeks in a public newspaper of the relevant county if serving by publication.
  • Servers must post the notice at the courthouse door AND publish in either an adjoining county’s newspaper or at the state capital if there’s no newspaper in the county.
  • Servers may leave documents with the defendant’s spouse or family member over 16 who is willing to accept service if personal service cannot be made with reasonable diligence.
  • Servers must also mail copies to the defendant at the same address by first-class mail when leaving documents with a family member.
  • Service is considered complete on the 10th day after mailing when using alternative service through family members.
  • The envelope must be marked “restricted delivery” for natural persons when serving someone outside the state by certified mail.
  • The summons may contain only the first party’s name on each side plus the name of the party being served when serving multiple defendants.
