New Jersey Rules of Civil Procedure

Per Rule 4 of the New Jersey Rules of Civil Procedure, here are some of the regulations pertaining to service of process in New Jersey:

  • Any competent adult (over the age of 18) without a direct connection to a case may serve intended recipients.
  • If good faith, verified attempts to serve a party fail, service can be made via certified or registered mail.

  • Acceptance of a service of summons must be signed by the defendant or defendant’s attorney.

Who a process server can serve in New Jersey

A process server in New Jersey can serve any of the following parties:

  • A competent individual over the age of 14
  • A member of the intended recipient’s household who is competent and over the age of 14
  • Parent, guardian, or legal custodian of a minor under the age of 14
  • Guardian of an incompetent adult
  • Individual proprietors of a business or property 
  • Managing agent, officer, or general partner of a partnership or unincorporated association
  • Director, officer, trustee, or managing agent of a corporation
  • Attorney General or designated representative of the state
  • Clerk, secretary, or presiding officer of a public organization

Hours a private process server can serve 

In New Jersey, a private process server cannot serve a recipient on Sundays or on recognized religious holidays. For example, you may not serve any party on Christmas Day. A process server in New Jersey can serve anyone between the hours of 6:00 a.m. and 10:00 p.m. from Monday to Saturday.
