A private process server in New Mexico is not permitted to serve the following: writs of attachment, writs of habeas corpus, and writs of replevin. Most private process servers also undergo training, although training is not required by the state.

In New Mexico, according to the Rules of Civil Procedure, a private process server can serve any of the following parties:

  • All summons should be issued by the court clerk.
  • Every complaint and summons should include the name of the court in which the complaint was filed, the name of the first party on each side, and the docket number of the case.
  •  A defendant has 30 days to respond to a claim or to file a counterclaim.
  • If a defendant fails to respond to a claim, the plaintiff may apply to the court for the compensation sought in the claim.
  • An original summons with proof of service shall be filed with the court.

Who a private process server can serve

In New Mexico, according to the Rules of Civil Procedure, a private process server can serve any of the following parties:

  • To an individual over the age of 18 — if an individual refuses service, a copy may be left at the location where service was attempted and is considered valid service if the location is verified.
  • An individual who is over the age of 15 and resides in the same home as the defendant if the defendant cannot be located.
  • A defendant’s business or place of employment.
  • A general or managing agent or officer of a domestic or foreign corporation, limited liability company, or unincorporated association.
  • If no agent or officer of a corporation is available, service can be made to the principal business location to a person in charge.
  • Governor and attorney general of the state of New Mexico.
  • Head officer of a state branch, bureau, commission, department, or institution.

Hours a process server can serve someone

Although some states have regulations in place prohibiting service on weekends and holidays, this is not the case in New Mexico. A process server in New Mexico can serve someone at any time and there are no legal restrictions on hours. 

However, general industry standards avoid serving papers before 6:00 a.m. or after 10:00 p.m. It’s a good idea to instruct a private process server to follow this procedure, but they can make several attempts to serve an intended recipient at different times.
