Process servers play an important role in the legal world. Legal documents can’t just be dropped in the mail or left on a defendant’s front porch. Rather, they need to be delivered directly to the correct person or a legally-authorized representative.
A process server, then, is a neutral third party who delivers legal documents notifying a specific individual that they have been named in a lawsuit.

Every state has specific requirements and statutes that govern the service of process. Some of the laws that Illinois process servers must follow include:
- In Illinois, process servers are not required to be licensed. Additionally, private detectives or licensed employees of private detective agencies can serve process without special appointment in counties with less than 2 million population. This includes Winnebago County.
- When serving an individual, the process server must identify the sex, race, and approximate age of the recipient and note the exact location, date and time service was made. False statements are punishable as contempt.
- If personal service is impractical, the plaintiff can request a comparable method of service with a detailed affidavit explaining why other methods failed.
- A corporation may be served by leaving process with any officer or agent in the state. Notification by publication is also permitted.
- Non-residents submitting to Illinois jurisdiction may be served outside the state in the same manner as within it. Affidavit of the server must note time, place and manner of service.
