Understanding the Role of a Texas Process Server

Curious about what process servers can and can’t do for your legal practice or business? Let’s go over the basics. 

A process server is a neutral third party who delivers important legal documents to defendants and other named parties in legal proceedings. These are documents that can’t be shipped through the mail or just dropped off on a person’s desk. Rather, there are specific rules about how process servers can and cannot do their work. This varies from state to state. 

Texas requires all process servers to be certified. 

The Firefly Legal approach to technology

For certification, potential process servers must: 

  1. Complete a 7-hour educational course about civil process service, no more than a year before applying. 
  2. Submit an application to the state and pay the certification fee ($200 for first-time applicants). 
  3. Pass a criminal history background check with both the Department of Public Safety (DPS) and the FBI. 

Texas process servers must be at least 18 years old.

In addition to these requirements from the state of Texas, we require our Firefly Legal servers to do the following:

Texas’s Process Serving Laws

There are a lot rules governing what process servers can and can’t do in Texas. Here are just a handful of the most important ones: 

  • No civil suit can be commenced or process served on Sunday, except in certain cases like injunctions or attachments (Rule 6)
  • Process servers must endorse all documents with the date/time received and details of service (Rule 16)
  • Only sheriffs, constables, or those 18+ specifically authorized by the court can serve process (Rule 103)
  • Process servers must execute and return process without delay after receiving it (Rule 105)
  • There are specific rules that determine how a person can serve process, including personal service, mail, leaving it with someone over 16 at the defendant’s location, or using other court-approved methods (Rule 106)
  • Servers must follow state-defined guidelines on how to document their attempts and completed service (Rule 107)
  • In some circumstances, Texas process servers may be able to serve outside of the United States (Rule 108a)
  • Subpoenas must meet certain form requirements and command attendance, production of documents, or both (Rule 176.1, 176.2)
  • Process servers can be held in contempt of court for failing to comply with a subpoena (Rule 176.8)
