How a process server works in Utah

A process server in Utah doesn’t have to be licensed. However, there are still state regulations that impact who can serve legal papers, how papers may be served, and who can be served.

Failure to meet any one of these requirements could significantly affect and hinder an attorney’s case. It’s also important to note that the service of process laws in Utah could change at any time. The right process server will remain current on any changes to laws and regulations.

Here are some of the current Utah laws on serving process:

  • All parties must be served in person or by mail.
  • Any legal papers can be served by a sheriff, constable, or US Marshall. 
  • A private process server can be any third party over the age of 18 who isn’t a respondent in a current court proceeding and hasn’t been convicted of a felony or a sex offense. 
  • A parent or legal guardian may be served that lists a minor as the intended recipient.
  • All court summons served must be signed by the plaintiff and the plaintiff’s attorney (Utah Code §78B-8-302).
  • A summons must be served within 120 days of the issued complaint (Utah Rules of Civil Procedure 4).
  • If a summons is not accepted by a defendant, a process server can file proof of service if the name of the process is stated and delivery is offered.

When can a Utah process server deliver legal papers?

In Utah, a private process server can deliver legal papers within 120 days of a filed complaint. If documents are not served within that four month window, any action against an unserved defendant might be dismissed without prejudice. A defendant must also be given adequate time to respond to a summons or file a counterclaim.

A process server in Utah is also permitted to serve papers to a residence, a business, or any place of employment.

Who Can be Served in Utah?

A private process server in Utah must adhere to the Utah Process Server Act, and 

can serve any of the following recipients:

  • Any named party in a case
  • A lawyer representing a defendant (if a named party has already retained counsel, a process serve must deliver documents directly to that attorney)
  • A Licensed Paralegal Practitioner (LPP) representing a named party
  • Designated officers of private companies 
  • Designated government officials 
  • Parents or custodial guardians of a minor named as defendants in a claim
  • Partners in a named business
