Who can become a process server? 

There are no licensing requirements for a process server in the state. However, according to state laws, a private process server in West Virginia must meet the following requirements:

  • Must be at least 18 years old
  • Must be an unbiased third party with no involvement or interest in the case
  • Proof of service must be filed with the courts
  • A delivered summons must be signed by the court clerk, bear the seal of the court, and include the name and contact information of the plaintiff’s attorney
  • A delivered summons must include the date and time a defendant is required to appear — failure to appear after verified delivery can result in an automatic judgement against the defendant
  • All summons should be served with a copy of the complaint
  • The process of a civil action begins with filing the complaint with the court, before service of process occurs

The West Virginia Rules of Civil Procedure allow a private process server to serve any of the following parties:

  • An individual who is competent and over the age of 14
  • A parent, guardian, or legal custodian of an infant, an individual under the age of 14, or an individual who is incapacitated 
  • A member of a named defendant’s household who is over the age of 16
  • A committee, fiduciary, guardian, or guardian ad litem of a convict
  • Director, officer, or trustee of a domestic private corporation
  • Member of city council or board of commissioners, clerk, city manager, mayor, recorder, or treasurer of a city, town, or village
  • President or member of a board of education
  • Agent, director, or trustee of a qualified business trust or foreign corporation operating in the state
  • Agent or attorney of a business trust or foreign corporation not qualified to do business in the state
  • Director, governor, or officer of an unincorporated association (such as a non-profit educational foundation or homeowner’s association)
  • If a corporation cannot be contacted, then the Secretary of State can be served as a statutory attorney in fact

It’s also important to note the following:

  • Service must be made within 120 days of a filed complaint
  • Service must be at least 7 days before a scheduled hearing
  • A defendant’s response must be made at least 2 days before a scheduled hearing

Hours a process server can serve

West Virginia is one of several states with time limitations on when a process server can serve legal documents. Service cannot occur on a Sunday, unless a specific exception is made.

However, there are no limitations in place on Saturdays or holidays. Although a process server can also deliver legal documents at any time of day, when possible, it’s a good idea to follow the industry standard of delivery — anytime after 6:00 a.m. and before 10:00 p.m.
