What is Nationwide Process Serving?

Process serving is Firefly’s expertise, but even more, it makes us glow. Firefly’s employees and servers are experts in the field. We know the rules—in some cases we even helped write them! Success in this business is more than just knowing the rules. It’s about efficiency, adherence to client instruction, fact documentation to withstand legal challenge, ethical action, and passion for being the best. That’s what makes the difference.

The Firefly Advantage

Here’s the truth about this business: process service vendors frequently claim they’re the “fastest,” but the reality is that among the best service firms, average serve times are comparable and consistent. Firefly is right there too. What separates Firefly from others is how it completes service: the care with which we attend to details to ensure accuracy and how we work with clients throughout the process to deliver exceptional promptness, accuracy and quality.

Higher Caliber of Process Server

Firefly sets a higher standard for our contracted process servers from the start. Before ever touching a file, we verify applicants’ certifications and ensure our servers fully understand all regulations, client expectations, procedures, and code of conduct.

Firefly continuously monitors server performance to make sure we keep only the best in the field, and update individual servers on their performance and areas of improvement. Our system consists of human and technological checks and balances while our quality assurance team audits performance on every file.

We don’t settle for less than the best process servers and we don’t expect our clients to either!

Your Roadmap to Understanding Our Law Firm

What is process serving?

Process serving is the method by which legal documents are delivered to an intended recipient. In order to file a civil lawsuit, you will need to let any named parties know, through legal channels, and give them an appropriate time window to respond to your filings with the courts.

An unbiased third party is required to act as your process server, and must verify that the intended recipient of your filing is served. Every state has different laws and regulations surrounding process serving, so it’s important to retain a legal services company with a track record of legal compliance and thorough knowledge of state laws.

If you’re an attorney and building a case, or if you’ve chosen to file a lawsuit without retaining counsel, you’ll need a process server to help build the foundation of your case. Civil court procedures require a mountain of time-sensitive paperwork, and without proper document delivery, your case may face many obstacles or be rendered null and void..

A process server is needed to ensure the safe and secure delivery of legal documents such as formal complaints, subpoenas, summons to appear in court, and notice of the filed lawsuit.

An experienced, reliable process server will use legal channels and innovative technology solutions to track down defendants and confirm proper delivery of a service of process.

Once you’ve entrusted your legal documents to a process server, the delivery process includes locating named defendants or witnesses in your lawsuit. The process server then works within legal channels and compliance with state and local process serving laws to ensure your documents end up in the right hands.

Although Firefly Legal offers national process serving, every state has its own regulations surrounding process services.

Firefly Legal provides real time updates on your case and you can contact our status department via email, or contact us through our toll-free number, (877) 963-3534 and select option 2.

Our case management portal offers live updates on the status of your process serving job, and our team will contact you when delivery is verified and confirmed.

Firefly Legal has stood at the forefront of the national legal services industry for over 25 years. A proven track record as an industry leader allows our process servers to adhere to the highest standards and best practices of process serving. If you utilize our services you can expect the following:
  • Adherence to detail
  • Commitment to attorney relationships
  • Confidentiality
  • Discretion
  • Efficiency
  • Innovative, customized solutions to meet your individual needs
  • Integrity
  • Nationwide branches
  • Open communication
  • Reliability
  • Real-time status updates
  • Regular service audits
  • Skip tracing services
  • Technological solutions
  • Trained and SOC2 certified process servers

The Firefly Legal team holds SOC2 Type 1 certification, which means our process servers are extensively trained in information security and compliance. This certification reaffirms our commitment to confidentiality.

Information security is the cornerstone of the national process serving industry, and SOC2 Type 1 certification ensures that there are enforced and secure access controls for the sensitive data our process servers handle.

Unfortunately, some named parties in a lawsuit may try to evade process serving, or may have recently moved. If our process servers cannot find your intended recipient, we will use the latest technology to quickly (and legally) find them.

Comprehensive skip tracing practices will be utilized to allow us to deliver your documents, in a timely manner, to the correct recipient. These practices may include an extensive search of confidential and public databases, social media accounts and Internet activity, and personal and professional histories.

If your intended recipient now resides out of state, our national process serving team located in that state will deploy their process servers to find them.

In short, yes. Many states require an unbiased third party for process serving. However, specific laws and regulations surrounding process servers do vary depending on the state.

For example, in Illinois, where Firefly Legal is headquartered, process servers are required to hold a license when serving in a city with 2 million people or less.

If you enlist our process servers, your services will include the due diligence package at no extra cost to you. This means that you’ll receive a comprehensive affidavit with detailed notes from your process server, delivery confirmation, recorded court filing, extensive skip tracing results, retrieved documents, and any other pertinent case information.

Each member of the national Firefly Legal process serving team will submit a detailed report for every process served. The due diligence package is an important reference file as you take the next legal steps in your lawsuit.
