Florida Regulations on Process Servers

The laws and regulations on process servers in Florida may vary from other states. Therefore, it’s important to use a professional process serving company that has comprehensive knowledge of Florida laws, and will ensure that their practices are in compliance with these laws.

In Florida, in a criminal case or an enforceable civil process, a process server must either be an authorized law enforcement officer or an unbiased third-party given permission by the court to serve legal documents.

The sheriff in your area of residence may maintain a list of valid, approved process servers who are legally permitted and designated to serve. A Florida process server must also be certified to perform serving duties.

Other Notable Florida Process Server Regulations

Per Florida statutes Title VI and 48.021–48.31, the following laws also apply to process servers:

  • A minor named as a defendant cannot be served directly. Instead, the parent or legal guardian of a minor should be served (48.041)

  • Appointed process servers must be full-time residents of the state (48.021)
  • Processes on out-of-state individuals or corporations doing business in Florida must be served to a representative of these parties in Florida (48.071)
